1. Agreement
This End User License Agreement ("Agreement") is between you ("User") and
SorrowRift ("Licensor") and governs your use of any SorrowRift app
or game that links to this Agreement (the "App"). By downloading,
installing, or using the App, you agree to this Agreement.
2. License grant
Licensor grants you a limited, non-exclusive, non-transferable,
revocable license to use the App for your personal, non-commercial
purposes, on devices you own or control, in accordance with the
applicable app store's terms of service.
3. Restrictions
You agree not to:
- Copy, modify, or create derivative works of the App.
- Reverse-engineer, decompile, or disassemble the App, except as permitted by law.
- Rent, lease, sell, redistribute, or sublicense the App.
- Remove or alter any proprietary notices in the App.
4. Ownership
The App and all intellectual property rights in it remain the property
of Licensor. This Agreement does not grant you any ownership rights.
5. In-app purchases
Some Apps may offer optional purchases through the app store's
in-app purchase system. What's on offer, if anything, is described
on that App's own store listing. All purchases are subject to the
app store's own terms and refund policies — we never handle your
payment details directly.
6. Termination
This license is effective until terminated. It terminates automatically
if you fail to comply with any term of this Agreement. Upon termination,
you must stop using the App and delete all copies.
7. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of
any kind, to the maximum extent permitted by applicable law.
8. Limitation of liability
To the maximum extent permitted by law, Licensor is not liable for any
indirect, incidental, or consequential damages arising from your use of
the App.
9. Apple App Store terms
If you downloaded the App from the Apple App Store, the following
additional terms apply, and take precedence over anything in this
Agreement that conflicts with them:
- This Agreement is between you and Licensor only, and not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
- Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- Licensor, not Apple, is responsible for the investigation, defense, settlement, and discharge of any claim that the App, or your possession and use of it, infringes a third party's intellectual property rights.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of this Agreement.
10. Third-party terms
Your use of the App is also subject to the Licensed Application End
User License Agreement terms required by Apple, and/or the Google Play
Terms of Service, as applicable to the platform you downloaded from.
11. Governing law
This Agreement is governed by the laws of England and Wales, without
regard to conflict-of-law principles. Nothing in this Agreement
limits any statutory rights you have as a consumer under UK law.
